DUN Manir kekal milik Pas September 16, 2008

PUTRAJAYA 16 Sept. – Kerusi Dewan Undangan Negeri (DUN) Manir, Terengganu kekal milik calon Pas, Datuk Harun Taib apabila Mahkamah Persekutuan hari ini menolak petisyen pilihan raya calon Barisan Nasional (BN), Wan Sagar Wan Embong.

Panel tiga hakim diketuai oleh Hakim Besar Malaya, Tan Sri Alaudin Mohd. Sheriff dan Hakim-Hakim Mahkamah Persekutuan, Datuk Ariffin Zakaria dan Datuk Zulkefli Ahmad Makinudin sebulat suara mengekalkan keputusan Mahkamah Tinggi yang membatalkan petisyen Wan Sagar.

Hakim Zulkefli ketika membacakan penghakimannya sebentar tadi antara lain menyatakan, Mahkamah Tinggi betul ketika memutuskan demikian kerana dakwaan rasuah dalam petisyen itu tidak merujuk secara tepat sama ada ia dilakukan oleh Harun atau orang lain dengan pengetahuannya.

Oleh itu, beliau menyatakan, fakta ringkas mengenai dakwaan berlakunya perbuatan rasuah seperti yang terkandung dalam petisyen Wan Sagar tidak mencukupi untuk mengaitkannya dengan ejen Pas.

Federal Court confirms PAS victory in Manir

PUTRAJAYA: The Federal Court here on Tuesdayconfirmed the election of Datuk Harun Taib of PAS to the Manir state seat after dismissing with costs the election petition of the Barisan Nasional candidate, Wan Sagar Wan Embong.

Chief Judge of Malaya Tan Sri Alaudin Mohamed Sheriff and Federal Court judges Datuk Arifin Zakaria and Datuk Zulkefli Ahmad Makinudin unanimously affirmed the order of the High Court that Wan Sagar’s petition to nullify the Manir election result in Terengganu was defective.

They held that the corrupt practice allegedly committed by the agents of Harun, the PAS candidate, as pleaded in Wan Sagar’s petition must be specific to succeed in his petition.

Justice Zulkefli, who delivered the judgment, said the High Court judge was correct in his decision that the petition was defective as it did not contain particulars of the alleged corrupt practice.

Wan Sagar is appealing against the decision of the High Court which on May 25 allowed Harun’s preliminary objection and held that Wan Sagar’s petition to nullify the Manir election result in Terengganu was defective as it did not contain particulars of corrupt practice, and summarily struck out the petition.

Harun won the seat with a 406-vote majority in the March 8 general election.

Harun was represented by counsel Mohd Ariff Yusof while counsel Firoz Hussein Ahmad Jamaluddin acted for Wan Sagar. – Berrnama
